Parenting agreement

  1. A parenting agreement is where separated parents or guardians record in a document the agreement they have reached in regards to the arrangements for looking after the children in a document.
  1. You do not need to go through the court to enter into a parenting agreement.   A parenting agreement cannot be enforced through the court.   However, you may use the parenting agreement as a basis for a parenting order to be sealed in the court.
  1. Often a parenting agreement will include:

a.  Arrangements for day-to-day care – the parents or guardians might agree, for example, that they will share day-to-day care of the children equally, or otherwise.

b.  Arrangements for contact – if one parent has the day-to-day care of the children, an agreement can record the arrangements for the children to spend time with the other parent, including special days such as birthdays and Christmas

c. Other parenting issues – an agreement might address issues to do with the children’s care, development and upbringing, such as where the children will reside, their school, religion, education and travel.

Parenting orders

  1. A parenting order records the parenting arrangements for the children in a court order.    This order can then be enforced through the court if it is breached, and or varied if circumstances change.
  1. A parenting order will include:

a. Arrangements for day-to-day care of the children

b. Arrangements for contact, which may be by agreement, or at set days and times.   It can also be ordered to be supervised.

c. The children’s place of residence,

d. It may also include details of how the parents will communicate, travel, schooling or medical issues for the children.
